1. Welcome to Sparsh Wellness
By accessing or using Sparsh Wellness (“our services”), you agree to be bound by these Terms of Service. These Terms constitute a legally binding agreement between you (“Guest,” “Client,” “you”) and Sparsh Wellness (“we,” “us,” “our”). If you do not agree to these Terms, please do not use our services.
2. Eligibility
To use Sparsh Wellness, you must: - Be at least 18 years of age - Provide valid identity verification via Aadhaar card - Have legal capacity to enter into binding agreements - Provide accurate, complete, and current information - Comply with all applicable Indian laws We reserve the right to refuse service or terminate accounts that do not meet these requirements.
3. Nature of Our Services
Sparsh Wellness provides professional therapeutic wellness services delivered by certified therapists, designed exclusively for stress relief of the nervous system, mind-body relaxation, holistic wellness therapy, and therapeutic touch and energy work. What we are NOT: a dating or romantic platform, an adult entertainment service, a massage parlor, a social networking app, or an escort/companionship service. Any expectation otherwise is strictly prohibited and grounds for immediate termination.
4. Studio Rules & Session Conduct
By booking a session, you mandatorily agree to the following studio rules: Rule 1 — No interruption during the session. Allow the therapist to maintain focus and flow, do not initiate disruptive conversation, trust the therapist's expertise, and respect silent meditation phases. Rule 2 — Mindful presence required. Feel the session deeply with awareness, focus on your inhale and exhale, allow nervous system relaxation to occur naturally, and maintain a calm, respectful demeanor. Rule 3 — Mandatory pre-session hygiene. You must take a bath/shower before arriving, use fresh clean clothing, maintain oral hygiene, and avoid strong perfumes. Failure to comply may result in session refusal without refund. Rule 4 — No mobile phones during the session. Phones must be switched off or on silent; no photography, recording or calls. Violation results in immediate session termination without refund. Rule 5 — Belongings must be secured. All personal belongings (phones, wallets, jewelry, watches, bags, devices, keys) must be kept in the designated complimentary lockers before the session begins. The studio is not liable for items not stored in lockers. Rule 6 — Therapist's right to terminate. If the Guest engages in any illegal, inappropriate, or improper actions, the therapist has the full right to immediately stop the session and leave the premises. No refund will be issued, the Guest may be permanently banned, and the incident may be reported to law enforcement. Illegal or improper actions include: physical assault or threats, sexual misconduct or inappropriate advances, verbal harassment or abusive language, possession or use of illegal substances, recording without consent, theft or property damage, refusing the therapist's professional instructions, bringing weapons or dangerous items, intoxication, or any unlawful conduct under Indian law.
5. Additional Studio Guidelines
Arrival time: arrive 15 minutes before your scheduled session. Late arrivals over 15 minutes may result in a shortened session without refund; sessions cannot be extended due to late arrival. Cancellation policy: - 24+ hours notice: full refund or rescheduling - 6–24 hours notice: 50% refund - Less than 6 hours: no refund (rescheduling at the studio's discretion) - No-show: no refund Health and medical conditions: you must inform us before the session of cardiovascular conditions, skin allergies or infections, recent surgeries or injuries, pregnancy, mental health conditions, or any contagious diseases. Failure to disclose may result in session refusal without refund. Dress code and modesty: clothing/coverage requirements are communicated before the session; modesty and dignity are maintained at all times; towels and coverings are provided. Communication: express comfort or discomfort respectfully during designated phases, use appropriate language at all times, and inform the therapist of pressure preferences politely.
6. Booking & Payment
Booking system: one active booking per customer at a time. Bookings are confirmed only after the admin assigns a therapist. A booking confirmation does not guarantee a specific therapist preference. Payment terms: payment options are advance or full amount, accepted via the secure Razorpay payment gateway. All amounts are in Indian Rupees. Receipts are issued automatically post-payment, and payment must clear before the session. Pricing: Basic Tantra (90 minutes) — ₹25,000; Cuddle Therapy (60 minutes) — ₹20,000; Velvet Bliss (60 minutes) — ₹20,000; Diverse Tantra (90 minutes) — ₹35,000. Prices are subject to change and are locked at the time of booking. Refunds: processed within 7–10 business days, issued only as per the cancellation policy. No refunds for sessions terminated due to client misconduct, late arrivals or no-shows.
7. Referral Program Rewards
Tier 1 — refer 1 friend: 40% off your next session. Tier 2 — refer 2 friends: 70% off your next session. Tier 3 (VIP) — refer 3 or more friends: 20% off all sessions for the next 4 months. Referral rules: a friend is considered successfully referred only after they complete their first paid session at our studio. Pending invites do not count. Rewards activate automatically once the referred friend completes their first session, are non-transferable and non-cashable, and apply automatically at the time of payment. Self-referrals are prohibited, and each customer can use only one referral code. Tier 3 VIP validity begins when the third friend completes their first session and applies only to sessions booked and paid within the 4-month window. Sparsh Wellness reserves the right to modify or terminate the program with prior notice.
8. User Account Responsibilities
Account security: maintain the confidentiality of your password, do not share account credentials, notify us immediately of unauthorized access, and use a strong, unique password. Accurate information: provide a valid Aadhaar number and authentic Aadhaar image, truthful personal information (name, age, sex), current contact information, and honest feedback after sessions. Providing false information may result in immediate account termination and legal action. One account per person: each Aadhaar can register only one account. Duplicate accounts will be terminated, and sharing accounts is strictly prohibited.
9. Therapist Conduct & Rights
All therapists at Sparsh Wellness are certified and trained professionals who maintain strict ethical standards, have undergone background verification, and are bound by confidentiality agreements. Therapists have the right to refuse service to any client at their professional discretion, terminate a session if rules are violated, leave the premises if feeling unsafe, report incidents to studio management and authorities, and decline requests outside their certified service scope. Both Guest and Therapist agree to maintain professional respect, clear communication, appropriate boundaries, and cultural sensitivity.
10. Feedback System
Feedback must be submitted within 1 hour post-session. Provide honest, constructive ratings (1–5 stars); written reviews must be respectful. Defamatory or false reviews may result in legal action. One feedback per completed session.
11. Prohibited Activities
You agree NOT to: use the service for any illegal purpose; harass or threaten therapists or staff; attempt to bypass security measures; reverse engineer or modify the platform; solicit illegal services; use bots, scripts, or automated tools; sell, transfer, or share your account; post offensive or inappropriate content; or violate any Indian or local laws. Violations may result in immediate account termination, no refunds, and legal action.
12. Confidentiality
We maintain strict confidentiality regarding your identity and session attendance, conversations during sessions, feedback and personal preferences, and medical or health information shared. We will not disclose your information unless required by law, necessary to protect safety, or with your explicit consent.
13. Limitation of Liability
Sparsh Wellness services are designed for relaxation and wellness. We do not provide medical treatment or diagnosis, do not cure diseases or medical conditions, recommend consulting doctors for medical issues, and are not responsible for individual reactions to therapy. To the maximum extent permitted by law, we are not liable for indirect or consequential damages, and our maximum liability is limited to the amount paid for the specific session. You agree to indemnify Sparsh Wellness from claims arising from your violation of these Terms, your misconduct on premises, your false information or impersonation, or any illegal activities.
14. Intellectual Property
All content, logo, design, and trademarks are the property of Sparsh Wellness. You may not copy, distribute, or use our intellectual property without permission. The Sparsh Wellness name and lotus mark are protected trademarks.
15. Termination
By you: you may terminate your account anytime by emailing support@sparshwellness.in. By us: we may suspend or terminate your account immediately if you violate these Terms, engage in illegal activities, provide false information, mistreat therapists or staff, or misuse the platform. Upon termination, active bookings will be cancelled, no refunds will be issued for violations, Aadhaar data is retained for 7 years (legal requirement), and other data is deleted within 30 days.
16. Dispute Resolution
We encourage resolving disputes amicably through direct communication with our support team, mediation through studio management, or customer feedback channels. Unresolved disputes will be settled through arbitration as per the Arbitration and Conciliation Act, 1996 (India), with a single arbitrator appointed by mutual consent. Arbitration venue: Bengaluru, India. Language: English. These Terms are governed by Indian law. Courts in Bengaluru, India have exclusive jurisdiction.
17. Force Majeure
We are not liable for failures due to natural disasters, acts of war or terrorism, government regulations or restrictions, pandemics or health emergencies, power outages or internet failures, or other circumstances beyond reasonable control.
